If you wish to create an I Like Museums trail, you will be subject to Newcastle City Council's (NCC) terms and conditions ('The Terms'). These terms and conditions are set out below. If you check the "I Agree" check box when creating a trail, you shall be taken to have accepted that these terms and conditions apply to your use of I Like Museums.

Please read these terms carefully: they set out the terms under which you can create a trail on the I Like Museums website. I Like Museums is owned and operated by Newcastle City Council ('NCC'). The agreement set out in these terms is made between you and NCC.

1. The Services
1.1 The Intellectual Property Rights for the trail shall belong to NCC and you shall have no right, title or ownership to the trail except as provided for under these Terms.
1.2 You grant to NCC a non-exclusive, worldwide, royalty free, transferable, licence in perpetuity to copy, distribute, publish and use the material you have included in your trail.
1.3 For the avoidance of doubt NCC shall not be obliged to create or incorporate the trail within I Like Museums if any information you supply to NCC is inaccurate or NCC in its absolute discretion, believes the inclusion of the trail would not be in the best interests of I Like Museums or NCC.

2. Service Availability and Warranties
NCC offers no guarantees as to availability of access to the site and makes no representations relating to the availability of the I Like Museums trail form or in respect of any security breaches which may occur.

3. Consequences of Termination
On termination of the agreement contained in these Terms your trail will be removed from the I Like Museums Website. You agree that NCC may continue to use the information which was submitted on the Form or subsequently for the purposes of statistical analysis in accordance with its Copyright and Privacy Policy available on the Site. Termination of the agreement contained in these Terms shall not affect any accrued rights or liabilities of either party, nor shall it affect the continuance in force of any provision of these Terms intended (whether expressly or impliedly) to continue after termination.

4. Liability
You shall not use the website trail to transmit or display material which is obscene, racist, threatening, menacing, offensive, defamatory, abusive, in breach of confidence, in breach of any Intellectual Property Rights or in breach of any applicable laws.

5. Personal Information/Data Protection
All information of whatever nature provided to NCC by you will be stored on secure computer systems and will only be accessed by authorized staff. Your information will not be passed on to a third party without your expressed permission.

6. Confidentiality
Each party undertakes to the other that while these Terms apply and thereafter it shall keep and procure that its employees and agents shall keep secret and confidential and not disclose to any third party, information or material of a confidential nature relating to the other received or obtained in pursuance of these Terms, unless such information or material is required by law to be disclosed by them or is in the public domain otherwise than by breach of these Terms.

7. Variations
NCC reserves the right to vary these Terms from time to time. Such changes shall be posted on the I Like Museums home page. Such changes in this manner shall be deemed to have been accepted by you if you continue to use the Website after a period of two weeks from the date of the posting on the Website home page.
